1. Agreement and acceptance

These Terms of Service apply to your access to and use of surefixpestcontrol.us, including its pages, forms, articles, images, and related digital services. By using the website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the website. You represent that you have the legal capacity to enter this agreement and will comply with applicable law.

2. Website and referral service

The website provides general pest-control information and a way to contact SureFix Pest Control. Depending on the request, we may help a homeowner connect with an independent local service contractor. Contractors are independent businesses, not employees, partners, agents, or joint venturers of SureFix unless a separate written agreement expressly says otherwise. A contractor’s availability, pricing, scope, schedule, workmanship, licenses, insurance, safety practices, and communications are the contractor’s responsibility.

Information on the website is general and may not fit every property. It is not a substitute for an on-site inspection, professional advice, or an emergency response. Use the Services page to understand the topics covered, then use the Contact page to begin a conversation.

3. Limited use license

Subject to these Terms, SureFix grants you a limited, revocable, non-exclusive, non-transferable license to access and view the website for your personal, non-commercial use. You may not copy, reproduce, republish, sell, rent, lease, distribute, frame, scrape, modify, create derivative works from, reverse engineer, or commercially exploit the website or its content without prior written permission. You must keep copyright, trademark, and other proprietary notices intact. This license ends automatically if you violate these Terms.

4. User obligations

  • Provide information that is accurate and not misleading when you use a form or contact channel.
  • Use the website only for lawful purposes and in a way that does not interfere with another person’s use.
  • Do not submit malware, malicious code, spam, unlawful content, or another person’s personal information without permission.
  • Do not attempt to bypass security, probe or scan the website, harvest contact details, impersonate another person, or access non-public systems.
  • Do not use website content to build a competing database, directory, or automated service.

We may limit or terminate access to the website when we reasonably believe these obligations have been violated.

5. Disclaimers

To the fullest extent permitted by law, the website and its content are provided on an “as available” and “as is” basis. SureFix does not represent or warrant that the website will be uninterrupted, secure, error-free, accurate, complete, current, or suitable for a particular purpose. We do not warrant or guarantee work performed by an independent contractor. Before hiring, you are responsible for verifying the contractor’s identity, scope of work, licenses, insurance, permits, references, and other qualifications required for your project.

Nothing on this website creates a contractor-client relationship, professional advice relationship, employment relationship, or agency relationship. You assume responsibility for decisions made from website content and for communications or transactions with independent contractors.

6. Limitation of liability

To the fullest extent permitted by law, SureFix and its owners, officers, employees, agents, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, data, goodwill, or business opportunity; or property damage, personal injury, delay, or interruption arising from or related to your use of the website, website content, a referral, an independent contractor, or a third-party link, even if advised of the possibility.

Where liability cannot be excluded, it will be limited to the greater of the amount you paid directly to SureFix for website access during the six months before the event giving rise to the claim or the minimum amount permitted by applicable law. Some jurisdictions do not allow every limitation, so some provisions may not apply to you.

7. Revisions and availability

We may correct, update, suspend, withdraw, or change any part of the website, content, form, service area, or feature at any time. We do not promise to update every page or maintain every feature. These Terms may also be revised from time to time. The revised version will be posted with a new effective date, and continued use after posting constitutes acceptance to the extent permitted by law.

9. Release

To the fullest extent permitted by law, you release and hold harmless SureFix and its owners, officers, employees, agents, affiliates, successors, assigns, and service providers from claims, demands, damages, losses, liabilities, costs, and expenses arising from or related to the website, its content, a referral, your communications with an independent contractor, or a contractor’s act or omission. This release does not waive rights that cannot lawfully be waived.

10. Arbitration and class-action waiver

Please read this section carefully. To the extent permitted by law, you and SureFix agree to try in good faith to resolve a dispute informally before starting arbitration or a lawsuit. If the dispute is not resolved, it will be resolved by individual, binding arbitration administered by a recognized arbitration provider under its consumer procedures, rather than by a jury trial or class action. The arbitrator may award the same individual relief that a court could award. The arbitration will take place in the county where you live or work, unless the parties agree otherwise, and may be conducted remotely when permitted.

You and SureFix waive the right to participate in a class, collective, consolidated, or representative action. You may opt out of this arbitration and class-action waiver by sending written notice to info@surefixpestcontrol.us within 30 days after first accepting these Terms. Your notice must include your name, address, the date you accepted these Terms, and a clear statement that you opt out. Small-claims matters may be brought individually when they qualify. Intellectual-property or unauthorized-access claims may be brought in court for injunctive relief.

11. Governing law and venue

These Terms and disputes relating to the website are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. If a dispute is permitted to proceed in court, the parties consent to the state and federal courts located in Hamilton County, Ohio, and waive objections to personal jurisdiction or venue to the extent permitted by law.

13. General terms

These Terms, together with the Privacy Policy and any page-specific terms, are the entire agreement about your use of the website. If a provision is held invalid, it will be modified to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. Headings are for convenience only. Provisions that by their nature should continue after termination—including disclaimers, limitations, release, arbitration, governing law, and intellectual-property terms—will survive.
